Your first, second, or third DUI in the state of California is considered a misdemeanor.
Certain factors can elevate a DUI to a felony, which are much more serious.
A DUI generally counts as a prior conviction for ten years.
There are special DUI laws and penalties for scooters and bikes.
If you injure or cause the death of someone in a DUI accent, you will be facing much more severe penalties than a standard DUI.
If previously charged with a past felony DUI conviction within 10 years, your current offense can be charged as a felony DUI even if it did not involve any aggravating factors, which results in 16 months to 4 years in prison and $390-1000 in fines.

1st DUI

2nd DUI

Fines are the same as the first DUI offense. $390-1000 plus “penalty assessment” fees.
Face 96 hours to 1 year in jail. Can occasionally be served through house arrest or jail-alternative work programs.
There is an automatic 2-year suspension from the criminal court and a 1-year administrative suspension. The defendant can also apply for a restricted license. If DUI is for drugged driving, they must complete 1 year of suspension before applying. All second offenders are required to have an IID for at least 1 year.
Probation periods are the same as the first offense – anywhere from 3 to 5 years. Conditionally, the defendant must complete 18 or 30-month DUI school as directed by the judge.

3rd DUI

Fines are the same as the first and second DUI offense. $390-1000 plus “penalty assessment” fees.
Jail sentence of 120 days (30 days if probation is granted and a 30-month DUI school is ordered) to 1 year.
There is an automatic 3-year suspension from the criminal court and a 1-year administrative suspension. The defendant can also apply for a restricted license. If DUI is for drugged driving, they must complete 1 year of suspension before applying for the restricted license. All third offenders are required to have an IID for at least 2 years.
Probation periods are the same as the first offense – anywhere from 3 to 5 years. Conditionally, the defendant must complete a 30-month DUI school.

4th DUI

A fourth DUI within 10 years can be charged as a felony offense. If so, it can mean 16 months to 4 years in prison and $390-1,000 in fines.
